42.03 By mutual agreement, the parties may use a mediator to resolve a complaint in relation to discrimination. The selection of the mediator is done by mutual agreement. For better security, severance pay for the abolition of severance pay for voluntary separation (resignation and retirement) made in accordance with 19.05 to 19.08 in Appendix “J” or other similar provisions in other collective agreements is considered a termination benefit for the management of this clause. Both sides defend and support neutrality and inclusion. To this end, the parties undertake to review the collective agreement for the duration of this agreement to determine the possibilities of making the language more gendered. The parties agree that changes in language do not result in a change in application, scope or value. The Australian Competition and Consumer Commission (ACCC) regulates collective bargaining under the Competition and Consumer Act 2010. 34.16 If it turns out that the complaint is such that a decision cannot be made below a certain level of authority, all levels, with the exception of the final level, may be eliminated by the agreement of the employer and the worker and, if necessary, of the institute. 7.9.2 Notwithstanding the provisions of the worker`s collective agreement relating to severance pay, a worker: who accepts an appropriate offer of employment in accordance with this party does not receive severance pay if inheritance tax is in effect and/or, in the case of a type 2 transitional employment agreement, if the new employer recognizes the worker`s long-term continued employment in the rating agency for severance pay and grants severance pay rights similar to those of the worker at the time of the transfer. However, a worker who is entitled to severance pay under paragraphs 19.06 B or c) of Appendix “J” receives this right at the time of the transfer. You must obtain accC approval before entering into collective bargaining, or you may be in violation of the law. The ACCC may authorize collective bargaining if the resulting public benefits outweigh any reduction in competition.
